This document contains the Terms and Conditions and your obligations and those of National Bank of Abu Dhabi (the "Bank" in relation to NbadDirect E-Banking Account (NbadDirect Account), and shall form the agreement between you and the Bank for NbadDirect Accounts and related services.

"NbadDirect" and "nbadOnline" are the trade names owned by the National Bank of Abu Dhabi and provide access to NbadDirect Account(s), various products and services as advised by the Bank from time to time to the Bank's Customers through a secure e-mail system.

You should read every definition, clause, phrase and sentence detailed in this document with utmost care and should not leave anything without fully understanding its meaning, interpretation and should follow instructions and requirements detailed therein without any exception. If you do not understand any part of this document or you require further details you should immediately contact the Bank and seek further clarification as deemed necessary.

All communications between you and the Bank including any advices from the Bank and your requests and/or Instructions to the Bank for executing any transaction will be in the English language. In the event of any dispute that may arise between you and the Bank and where it necessitates to refer the dispute to a court of law in the UAE, the relevant document will be translated to the Arabic language by a legal translator registered with the Ministry of Justice.

If you wish to establish a personal Account relationship with the Bank through an NbadDirect Account, you must have attained the minimum age of eighteen Gregorian years. If you are eighteen Gregorian years, you can open and operate a Savings Account with the Bank. However, until you attain twenty-one Gregorian years, you will not be permitted to open and/or operate a Current Account where the use of Chequebooks is permitted. An exception to this requirement is that if you have attained eighteen Gregorian years and employed with a government or a semi-Government entity, then you will be permitted to open and operate a Current Account using Chequebooks.

If you are a non-resident, i.e. you do not possess a valid residence visa in the UAE, then you are not entitled to open and/or operate a Current Account where the use of Chequebooks is permitted. There are no restrictions on residents and non-residents to open and/or operate a Savings Account provided they have attained eighteen Gregorian years.

Current and Savings Accounts may only be opened in AED only. Fixed (Time) Deposit Account(s) may be opened in any other major currency(ies) acceptable to the Bank.

To operate an NbadDirect Account and obtain the relevant Banking services, you need to have access to nbadOnline, the Bank's secured Internet Banking Service and you should posses one or more of the Bank's Debit Cards (i.e. Cashplus and/or Cashplus Global Card). You may also use the Bank's Customer Contact Centre (Call Centre), the Bank's ATMs, Self Service Branches or Cash/Cheque Deposit Machines for all services available through these channels such as accessing information on your Account(s) and/or executing selective financial and/or non-financial Transactions.

Each heading contains detailed information related to the subject heading and, where applicable, the Terms and Conditions governing the operation of the relevant product and/or service the Bank could offer to you under NbadDirect. 7.1 Introduction and general requirements.
  
 
7.1.1 Welcome to the new NbadDirect Service, the Service through which you will be able to conduct all your personal Banking Transactions online from any where any time using the "nbadOnline" secured Internet Banking Service, the Bank's ATMs, Self Service branches and Cash/Cheque Deposit Machines.
7.1.2 Your NbadDirect Account will enable you to avail variety of functions, products and services. Once you open an NbadDirect Account, you can access the Account through the "nbadOnline" secured delivery channel and seek a product and/or a service detailed therein subject to the Terms and Conditions related to the relevant product or service.
7.1.3 To establish your relationship with the Bank as an NbadDirect Customer, you must be physically present in the UAE and need to open either a Current or a Savings NbadDirect Account with the Bank. You will open a Current or Savings NbadDirect Account in AED by completing the required information on the prescribed Account opening form available on the Bank's Website www.nbadDirect.com and electronically submitting the form. Subsequently, the Bank's Direct Sales Staff will call you, take an appointment and visit you for completing the Account opening formalities.
7.1.4 It is your sole and absolute responsibility to keep the Bank informed of any change in your resident status, permanent and/or temporary addresses(es), employment details, postal contact number(s), passport/visa changes, e-mail address(es) and/or any other information that would be necessary and required by the Bank.
7.1.5 You need to sign the hardcopy of these Terms and Conditions ONLY once at the time of opening the NbadDirect Account. However, once an NbadDirect Account is opened, it will be your sole responsibility to periodically review the Terms and Conditions from the Bank's Website www.nbadDirect.com and keep yourself updated with the additions, variations, changes or deletions, if any. If there is any specific change in the Terms and Conditions that might have any legal implication, the Bank would forward an e-mail notification to you advising of the relevant amendment or the variation and the Bank will not seek your acceptance or agreement on any revised document published on its Website.
7.1.6 While you can access your NbadDirect Account from anywhere and electronically process Transactions, with the exception of auto-generated e-mail notifications from the Bank to you, hardcopies of all correspondences and other documents in relation to your NbadDirect Account(s) will be retained at a central location in the Bank's Head Office building situated in the Emirate of Abu Dhabi.
7.1.7 You shall operate the NbadDirect Account under your single authority. You can neither appoint another person as your attorney or agent to operate your NbadDirect Account nor can you jointly operate the Account with another individual.
7.1.8 If you are an existing individual Account Holder maintaining an Account with a branch of the Bank and now wish to open an NbadDirect Account, you may do so. All your existing Accounts with the Branch will be linked under the Central Information File (CIF) assigned by the Bank and you can continue operating the Account(s) with your branch as per the agreed mandate for that respective Account. While you can access those Accounts using nbadOnline for inquiries, you cannot operate the Account for the features applicable to the NbadDirect Account.
7.1.9 You will not receive Account statement(s) in hard copy format for any of your NbadDirect Account(s) detailing the Transactions performed on the Account(s). However, you can view all Transactions posted to the Account covering the past one year by using the "search" option available in nbadOnline and print the records at your convenience.
7.1.10 In the event you require an Account statement for your Current or Savings NbadDirect Account in hard copy format, you may submit a request to obtain such hard copy against a nominal fee charged by the Bank.
7.1.11 As an NbadDirect Account Holder, you may choose one of the following delivery channels to request the Bank for executing a financial or a non financial transaction and/or obtain a product or a service:-
 
  
i.
Electronically submitting requests through the secured electronic channel using the prescribed Request Form available on nbadOnline.
ii.
Using the Remittance, Payment or Transfer options available through nbadOnline and electronically submitting the Request.
iii.
Using the Bank's Call Centre services.
iv.
Using the Bank's ATM network.
v.
Calling the dedicated Direct Sales Force Staff (please see related Terms and Conditions below).
  
7.1.12 If seeking a product or a service is not possible through one of the above delivery channels, you may approach any of the Bank's branches, apply for the product or seek the service by completing the relevant formalities as appropriate.
7.1.12.1 In all cases, if you wish to obtain a service from any NBAD branch that could be otherwise processed electronically by submitting the relevant request using "nbadOnline", the Bank may levy a service charge for rendering the service at it's branch counter. (This charge is to discourage you using a branch network to process a transaction that is otherwise available through electronic processing free of any charge.)
7.1.13 With the exception of Card related services, Balance Confirmation Letters and Requests for Personal Loans, all your Requests that are electronically submitted to the Bank will be acknowledged by the Bank after executing the relevant transaction by an e-mail notification sent to your preferred e-mail address as per Bank records.
7.1.14 Additionally, all financial Transactions effected in your NbadDirect Account(s) on any day will be forwarded in a consolidated advice form by an e-mail notification to your preferred e-mail address as per Bank records.
7.1.15 You must always ensure that the preferred e-mail address you have provided to the Bank is immediately updated as and when there is a change in the address using the "Update Contact Details" option available on nbadOnline.
7.1.16 Notifications and consolidated end of day transaction advices forwarded to your e-mail address are automatically generated and do not require an authorized signature from the Bank.
7.1.17 All notifications sent by e-mail to your preferred e-mail address are for information purposes only and the Bank will not be liable nor will it bear any responsibility if your e-mail address is incorrect or the message is incomplete, undelivered, wrongly delivered, hacked, duplicated and/or forged.
7.1.18 Irrespective of the e-mail notification(s) that you receive from the Bank addressed to your preferred e-mail address, you shall periodically check the details of all financial Transactions that are posted to your NbadDirect Account(s) by accessing the Account through nbadOnline or calling the Bank's Call Centre or through the Bank's ATMs. If you find any discrepancy, you should immediately bring it to the attention of the Bank by providing all relevant details. If no objection is raised within 15 days form the date of the relevant transaction, it will be treated as correct and agreed by you. Any objection raised after the 15 days period will not be accepted or entertained by the Bank.
7.1.19 For all your general correspondence with the Bank, you will only use the Bank's Secured e-mail option available through nbadOnline.
7.1.20 The e-mail messages or responses that you receive from the Bank through "nbadOnline" (hereinafter referred to as "Secured e-mails") are secured using SSL 128 bit encryption and certified by Comtrust.
7.1.21 The Bank may send you the following types of messages to your preferred e-mail address as per it's records for the purpose of your information:
  
a.
Notification(s) confirming transaction(s) that are processed by the Bank against request(s) electronically submitted by you.
b.
End of day Notification in consolidated form detailing all financial Transactions processed on NbadDirect Account(s) during that day.
c.
General messages related to marketing of new products/services the Bank offers to its Customers.
d.
Alert messages related to Internet Security issues.
e.
Information related to activation of nbadOnline Password.
  
7.1.22 7.1.22 End of Day Notifications describing Transactions on NbadDirect Account(s) are auto generated by the system and therefore you need not respond to the e-mail. You should immediately communicate any discrepancy(ies) using the Bank's Secured e-mail available through nbadOnline.
7.1.23 7.1.23 You may communicate with the Bank via e-mail using your preferred ID for general inquiries and/or to seek information on the Bank's products and services. However, under any circumstances, you should not mention your Account Number with the Bank, Debit/Credit Numbers, Password(s) etc., on such messages sent using your preferred e-mail ID. The Bank will neither be liable nor take any responsibility for misuse of information by any unauthorized person(s).
 
7.2 Internet Banking Services.
  
 
7.2.1 Definitions:In this document the following words and phrases shall have the meanings as set below unless the context indicates otherwise.
  
Account(s)
User's Account maintained with the Bank which is eligible for operations through the use of Internet Banking.
Bank
National Bank of Abu Dhabi, a Public Joint Stock Company, its successor(s) and/or assignee(s).
Business/Working Day
A day on which the Bank is open for operations in U.A.E.
Customer
An individual who maintains an Account with the Bank and who is authorized to conduct Transactions and/or Instructions via the Service. All references to the Customer in the masculine gender shall be deemed to include the feminine gender.
Instructions
Refers to the electronic data initiated remotely by the User and electronically transmitted via the Internet to the Bank.
Internet Banking
Refers to the nbadOnline Internet Banking Service offered by the Bank which provides the User with services such as balance enquiry, details about Transactions in the Account(s), transfer of funds and/or other services as the Bank may decide to provide from time to time. The availability or otherwise of any particular service shall be at the sole discretion of the Bank.
nbadOnline
Refers to the Internet Banking Service provided by the Bank that is accessible via Internet to conduct Transactions and Instructions on the Account(s).
Password
A confidential group of at least 8 alphanumeric characters formulated by the Bank or the User which when used in conjunction with the assigned User ID gives access to "nbadOnline".
Payment
Fund Transfers into any Account maintained by any person with the Bank.
Personal Information
Information provided by the User to the Bank.
Remittances
: Fund Transfers from Customer's Account to any Account maintained with any other bank other than the Bank.
Secure ID
Numeric code electronically issued by the Bank and transmitted through a token device delivered by the Bank to the Customer.
Secured e-mail
Refers to the mail option available within nbadOnline, accessible to authenticated Users.
Security Tools
User ID, Password, Secure ID and any other means of security implemented by the Bank from time to time for the User to access the Service.
Service
Electronic Banking system which enables the "User" to conduct Transactions and Instructions on the Account with the Bank via the Internet.
Sign-On
Refers to the process of successfully logging-in to nbadOnline using correct combination of User ID and Password.
Terms
Refers to the Terms and Conditions stated herein for the use of Internet Banking.
Transactions
Instructions affecting the Customer's Account(s).
Transfers
Fund Transfers between Customer's Accounts in the Bank.
User
Any individual, either a Customer of the Bank or not, who has access to the internet
Website
Refers to the Website owned, established and maintained by NBAD located at the URL http://www.nbad.com OR http://www.nbadDirect.com
  
7.2.2Applicability of Terms: These Terms form the contract between the Customer and the Bank for Internet Banking. The Customer shall apply to the Bank in the prescribed application for use of nbadOnline, the Bank's Internet Banking Service. The Bank shall be entitled at its sole discretion to accept or reject such applications. By applying for Internet Banking, the Customer acknowledges and accepts these Terms.
7.2.3 Internet Banking Service: For the purpose of availing Internet Banking, the Customer would need to be a current Internet User or have legal access to the Internet. The Bank will advise from time to time the necessary Internet software requirements such as browsers which are required for using Internet Banking. There will be no obligation on the Bank to support all the versions of such Internet software.
7.2.4 Unauthorized Access: The Customer shall take all necessary precautions to prevent unauthorized and illegal use of Internet Banking and unauthorized access to the Accounts provided by Internet Banking.
7.2.5 Internet Banking Access: The Customer would be allotted an Internet Banking User ID (i.e. your nbadOnline User ID) and a secret Password by the Bank in the first instance. The Customer will be required to change the Password assigned by the Bank on accessing Internet Banking for the first time. As a safety measure, the Customer shall change the Password as frequently thereafter as possible. In addition to User ID and Password the Bank may, at its discretion, advise the Customer to adopt such other means of authentication including but not limited to digital certification and/ or smart cards. The Customer shall not attempt or permit others to attempt accessing the Account information stored in the computers of the Bank through any means other than the Internet Banking. Customer access to the Service will be automatically blocked if the login Password is entered incorrectly for five consecutive times. Thereafter, the Customer may contact the Bank for further assistance and request for a new login Password to be delivered through courier for collection against acknowledgement. However, if the Customer prefers not to obtain a new Password, the Bank would allow further five attempts to login with the existing Password by reactivating the existing Password. Moreover, if the Customer again fails to login successfully, the Bank will reset the login Password, issue a new login Password which will be delivered to the Customer by courier against acknowledgement.
7.2.6 Internet Banking Password: The Customer unconditionally undertakes to have Internet Banking Password (i.e. your nbadOnline Password) of such number of letters/digits as may be notified by the Bank from time to time and ensure that the same is kept confidential; and not to let any unauthorized person have access to the Computer while the Customer is accessing the Internet Banking. When a request is made by the Customer for a new login Password due to loss, forgotten Password or if the Customer has established that existing login Password is compromised, the Bank will reset and issue a new login Password for delivery through courier. Courier representative will only deliver the Password upon identification of the Customer against photo ID and obtain acknowledgement from the Customer. The Customer agrees and acknowledges that the Bank shall in no way be held responsible or liable if the Customer incurs any loss as a result of information being disclosed by the Bank regarding his Account(s) or carrying the Instruction of the Customer pursuant to the access of the Internet Banking and the Customer fully indemnifies and holds harmless the Bank in respect of the same. The Customer shall maintain the secrecy of all information of confidential nature and shall ensure that the same is not disclosed to any person voluntarily, accidentally or by mistake.
7.2.7 Secure ID: When the Secure ID is provided by the Bank it will be the responsibility of the Customer to ensure that the same protection afforded to Passwords are afforded to this device as well and the Customer should also ensure that no one else other than himself/herself uses the device. In using the device the Customer will follow the guidelines which will be provided by the Bank along with the device.
7.2.8 Maintenance Of Sufficient Balance: The Customer shall ensure that there are sufficient funds (or prearranged credit facilities) in the Account for operations through the Internet Banking, and the Bank shall not be liable for any consequences arising out of the Bank's failure to carry out the Instructions due to inadequacy of funds and/or credit facilities provided always that the Bank shall at its sole discretion, be entitled to carry out the Instructions notwithstanding such inadequacy without seeking the prior approval from or notice to the Customer and the Customer shall be responsible to repay the resulting overdraft along with any interest accrued thereon, advance or credit thereby created and for all related costs and charges.
7.2.9 Funds Transfer Through Internet Banking: The Customer shall not use or attempt to use the Internet Banking for funds transfer without sufficient funds in the relevant Account or without a pre-existing arrangement with the Bank for the grant of an overdraft. The Bank will endeavour to effect funds transfer transaction received through Internet Banking subject to availability of sufficient funds in the Account. The Bank shall specify from time to time the limit for carrying out various kinds of funds transfer or any other services through Internet Banking. The said facility will be provided as per conditions specified by the Bank from time to time. The Bank shall not be liable for any omission to make all or any of the Payments or for late Payments due to circumstances beyond its reasonable control.
7.2.10 Authority to the Bank for Internet Banking: The Customer irrevocably and unconditionally authorizes the Bank to access all his Account(s) for effecting Banking or other Transactions performed by the Customer through the Internet Banking. The Instructions of the Customer shall be effected only after authentication of the Customer in accordance with the prescribed procedure for Internet Banking. The Bank shall have no obligation to verify the authenticity of any transaction received from the Customer other than by these means of verification. The read-out, the faxed /e-mail output or the printed output, if any, that is received by the Customer at the time of operation of the Internet Banking is a record of the operation of the computer by the Customer and shall be accepted as conclusive and binding for all purpose. All the records of the Bank generated by the Transactions arising out of the use of the Internet Banking, including the time the transaction recorded shall be conclusive proof of the genuineness and accuracy of the transaction. While the Bank shall endeavour to carry out the Instructions promptly, the Bank shall not be responsible for any delay in carrying on the Instructions due to any reason whatsoever, including due to failure of operational systems or any requirement of law.
7.2.11 Instructions: All Instructions for operating the Internet Banking shall be given through computer by the Customer in the manner indicated by the Bank. The Customer is also responsible for the accuracy and authenticity of the Instructions provided to the Bank and the same shall be considered to be sufficient to operate the Internet Banking. The Bank shall not be required to independently verify the Instructions; an Instruction is effective unless countermanded by further Instructions. The Bank shall have no liability if it does not or is unable to stop or prevent the implementation of the initial Instruction. Where the Bank considers the Instructions to be inconsistent or contradictory it may seek clarification from the Customer before acting on any Instruction of the Customer or act upon any such Instruction as it deems fit. The Bank has no obligation to keep a record of the Instructions to provide information to the Customer or for verifying Customer's Instructions. The Bank may refuse to comply with the Instructions without assigning any reason and shall not be under any duty to assess the prudence or otherwise of any Instruction and have the right to suspend the operations through the Internet Banking if it has reason to believe that the Customer's Instructions will lead or expose to direct or indirect loss or may require an indemnity from the Customer before continuing to operate the Internet Banking.
7.2.12 Accuracy of Information: The Customer is responsible for the correctness of information supplied to the Bank for use of the Internet Banking. The Bank accepts no liability for the consequences arising out of erroneous information supplied by the Customer. If the Customer notices an error in the information supplied to the Bank either in the application form or any other communication, he shall immediately advise the Bank which will endeavour to correct the error wherever possible on a "reasonable efforts" basis.
7.2.13 Liability of the Customer and the Bank: The Bank shall not be liable for any unauthorized Transactions occurring through the Internet Banking and the Customer hereby fully indemnifies and holds the Bank harmless against any claim, action, suit or proceedings of any nature initiated against it or any loss, cost or damage incurred by it as a result thereof. The Bank shall under no circumstance be held liable to the Customer if the Internet Banking is not available in the desired manner for any reason, including but not limited to, natural calamities, legal restraints, faults in the telecommunication network or network failure, or any other reason beyond the reasonable control of the Bank. Under no circumstances shall the Bank be liable for any damages whatsoever whether such damages are direct, indirect, incidental or consequential and irrespective of whether any claim is based on loss of revenue, interruption of business or any loss of any character or nature whatsoever and whether sustained by the Customer or by any other person. Illegal or improper use of the Internet Banking shall render the Customer liable for payment of financial charges as decided by the Bank and/or will result in suspension of the operations through the Internet Banking.
7.2.14 Indemnity: In consideration of the Bank providing the Customer the access to Internet Banking, the Customer shall indemnify and hold the Bank, its directors, officers, employees and agents, indemnified against all losses and expenses on full indemnity basis which the Bank may incur, sustain, suffer or is likely to suffer in connection with the Bank's execution of the Customer 's Instructions and against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses that may arise as a consequence or by reason of providing a Service through Internet Banking for any action taken or omitted to be taken by the Bank, its directors, officers, employees or agents, on the Instructions of the Customer . The Customer will pay the Bank such amount as may be determined to be sufficient to indemnify it against any such, loss or expenses even though they may not have materialised or are contingent in nature.
7.2.15 Disclosure of Information: The Customer agrees that the Bank or their contractors may hold and process his Personal Information and all other information concerning his Account(s) on computer or otherwise in connection with the Internet Banking for analysis, credit scoring and marketing. The Customer also agrees that the Bank may disclose, in strict confidence, to other institutions, such Personal Information as may be reasonably necessary for reasons inclusive of but not limited to participation in any telecommunication or electronic clearing network, in compliance with a legal directive, for credit rating by recognized credit scoring agencies or for fraud prevention purposes.
7.2.16 Change of Terms: The Bank shall have the absolute discretion to amend or supplement any of the Terms at any time and will endeavour to give prior notice of fifteen days for such changes wherever feasible. Such change to the Terms shall be communicated to the Customer by using any Internet Banking services or any new services as may be introduced by the Bank, the Customer shall be deemed to have accepted the changed/varied Terms.
7.2.17 Non-Transferability: The grant of Internet Banking to a Customer is not transferable under any circumstance and shall be used only by the Customer.
7.2.18 Termination of Internet Banking: The Customer may request the termination of the Internet Banking at any time by giving an authenticated notice of at least 15 days to the Bank. The termination shall take effect on the completion of the fifteenth day. The Customer will remain responsible for any Transactions made through the Internet Banking until the time of such termination. The Bank may withdraw or terminate the Internet Banking at anytime either entirely or with reference to a specific Service or Customer ; or in case of breach of Terms by the Customer , without a prior notice; or if it learns of the death, bankruptcy or loss of legal capacity of the Customer .
  
7.2.19The Customer can seek any clarification on Internet Banking Service from the Bank's Toll Free No. 800 2211.
 
7.3 System Security Measures
  
7.3.1 For your and our security, you should follow the additional security measures/guidelines detailed below:
 
a.
You must never write down or record your "nbadOnline" Password(s) anywhere that can be seen/understood by some one else.
b.
You must immediately destroy any advice which you may receive from the Bank concerning your "nbadOnline" Password.
c.
You should not access "nbadOnline" from any computer connected to a local area network or any public internet access device or access point without first making sure that no one else will be able to observe or copy your Password or obtain access to your Account.
d.
When you access "nbadOnline", you should not leave the terminal from which you have accessed "nbadOnline" or let any one else use that terminal until you have completely logged off at the end of your session.
e.
While the Bank will adopt measures which it considers reasonable to help ensure the security of "nbadOnline", you are solely responsible for the security of your Passwords.
f.
You agree to contact the Bank immediately if you suspect that another person knows your Password, any other related information or if there has been any unauthorized access to your Account. You agree to check carefully the records of Transactions on your Account(s) and inform the Bank of any discrepancies. The Bank may ask you to confirm in writing details of any mistake or unauthorized access to your Account.
g.
If your Password is used by someone else with your permission or as a result of your failure to abide by the measures stated above, you may have to pay to the Bank any losses which the Bank suffers as a result.
h.
The Bank may require your help and you agree to assist the Bank and any relevant authority in trying to recover any loss arising from any unauthorized access to your Account and you agree to provide any such help as may be requested from you.
i.

Ensure that the "Secured by Comtrust" seal appears on the login page where nbadOnline User ID and login Password are entered. Ensure that nbadOnline login page is a legitimate Comtrust secured by digital certificate.

Ensure that the "Lock" icon appears in your browser (Internet Explorer or Netscape Navigator) which could be clicked to get details of the server and other security certification details that guarantee that the remote computer is identified and certified as "online.nbad.com"

Ensure that the status (validity) of digital server certificate is "Valid" at the time of login. This can also be determined by clicking on the 'Lock' icon on your browser.

NbadDirect Account Users must ensure that login is performed through the Bank's Website* accessible only through the URL http://www.nbad.com.
["Website" refers to the National Bank of Abu Dhabi Website which is established, owned and maintained by National Bank of Abu Dhabi and located at URL http://www.nbad.com].

7.4 Direct Sales Force (DSF) Staff
  
 
7.4.1To provide you with a personalized Customer service, the Bank has appointed a team of dedicated and experienced Sales Staff who are known as "Direct Sales Force (DSF)".
7.4.2DSF staff are the authorized personnel appointed by the Bank to visit you, discuss all your Banking requirements, clarify queries and assist you in completing the formalities required to be completed by you.
7.4.3 The DSF staff shall, at all times, carry an Identity Card issued by the Bank bearing his/her photograph embossed on the Card. Names and identification details of all DSF staff are published in the Bank's Website www.nbadDirect.com for your information. Prior to providing any information to or seeking a service from the DSF staff, you should ensure the authenticity of the ID Card carried by the DSF staff by verifying the details/photograph of the DSF staff published in the Bank Website.
7.4.4 While a DSF staff is authorized/permitted to receive and/or deliver all Banking documents in relation to Banking operations, under no circumstances, the DSF staff is permitted to receive/deliver Cash or other valuables from/to you. Whenever you handover any negotiable document (Cheques, Bills etc.,) you must hold a copy of the document for your records and seek an official receipt from the DSF staff. The DSF staff is authorized to issue an acknowledgement receipt carrying the Bank stamp and duly signed.
 
7.5 Current and Savings Accounts
  
 
7.5.1 You can open either a personal Current or Savings NbadDirect Account in AED by completing the following:
  
i.
Access the prescribed Account Opening Form available on the Bank's Website www.nbadDirect.com.
ii.
Complete the Form with relevant details
iii.
Print the Form (if possible) for your records.
iv.
Review the data you have completed and ensure correctness.
v.
Submit the Form electronically.
vi.
Keep your valid passport and a copy of the passport.
vii.
If you are a resident of UAE and you wish to open a Current Account, make sure to retain a copy of the passport containing the residence visa.
  
7.5.2The DSF staff will first call you on the number you have provided on the Account Opening Form, take an appointment, meet you at a mutually agreed time and place and explain the process involved and the further requirements you need to follow.
7.5.3 You will be required to sign a hard copy of this document on the format provided to you by the DSF staff.
7.5.4 Once your Account is opened, the Bank will forward to you the newly opened NbadDirect Account number, Chequebook (for Current Accounts only) and Debit Card(s) in a sealed envelope through the Bank's Official Courier.
7.5.5 You will also receive the Personal Identification Number (PIN(s)) of Debit Card(s) and nbadOnline Password in a separate sealed envelope through the Bank's Official Courier.
7.5.6 On receipt of the Chequebook, nbadOnline Password, Debit Card(s) and related PIN(s), you will acknowledge receipt of all the documents on the Acknowledgement Note attached to the sealed envelopes and hand it over to the Courier Company's representative.

Note: For the purpose of this document, the term "Acknowledgement Note" means the format that the Customer signs to confirm receipt of the Cheque book, Debit Card, Debit Card PIN and nbadOnline Password.
7.5.7 Once the process is completed, the Bank's Internet Banking Unit will call, identify you by seeking answers to certain security questions and activate your nbadOnline Password.
7.5.8 Your Debit Card(s) will be activated by the Bank upon receiving the relative Acknowledgement Note.
7.5.9 You will abide by the following Terms and Conditions:
 
 

TERMS AND CONDITIONS CURRENT AND SAVINGS ACCOUNT

1. Withdrawals may be made only against an "available balance" (see para 2 below) or in case of Current Account, within an agreed overdraft limit, in cash, against Cheques/Withdrawal Slips which should be drawn on forms Issued or approved by the Bank and against written orders to pay or transfer.
2.
a)
The Bank shall credit the Customer's Account with sums which may be paid in for such purpose by the Customer. The Bank may also credit the Customer's Account with any amount paid in or transferred by any third party for the benefit of the Customer.
b)
Cheques and other instruments drawn to the order of Customer or to bearer will be accepted for collection but may not be drawn against until cleared, the Bank reserves the right to debit the Customer's Account with the value of any returned cheque for any reason whatsoever.
c)
When a Cheque or a Withdrawal Slip drawn on one branch of the Bank is presented for payment at another branch of the Bank, the Bank shall have the right in its entire discretion to pay the Cheque or Withdrawal Slip presented or to dishonour it without being obliged to furnish justifications
d)
For the purpose of these conditions the term "available balance" means the amount standing to the credit of the Account less any cheques or other payable orders deposited which are drawn on other banks and which have not been cleared.
3. The Bank may at any time in its discretion stop operation of an Account, whether it is in debit or in credit, by notifying the Customer in writing and the Customer shall thereupon repay the amount of any debit balance and for Current Accounts, any interest or other charges and expenses accrued thereon
4. The Bank may at any time and without notice to the Customer combine or consolidate all or any of the Customer's Accounts at any of its branches and set off or transfer any sum or sums standing to the credit of any one or more of such Accounts or any other asset in the Bank's custody and control in or towards satisfaction of any Customer's liabilities to the Bank on any other Account or in any other respect whether such liabilities be actual or contingent, primary or collateral, several or joint.
The combination, consolidation, set-off and transfers referred to in this Clause may be made on one or more occasions and at any time at the Bank's absolute discretion. The exercise or non-exercise of its right under this Clause shall not affect any right to security held by the Bank.
5.

The Bank has the right without reference to the Customer to debit the Customer's Account with all expenses, fees, interest and charges, commissions, stamp duties, postage, telex, telephone, other telecommunication charges and all other expenses paid or incurred on behalf of the Customer or arising out of any dealings between the Bank and the Customer or by the Bank and third parties pursuant to the Customers' Instructions.

6.

The Bank's books, records and entries shall, in the absence of manifest error, form conclusive evidence in any dispute between the Customer and the Bank.

7.

The Bank shall not be responsible for any loss of or damage to any cheque or any other thing while the same is in transmission from the Bank to the Customer or from the Customer to the Bank or during any collection or similar process. Any letter, advice, statement or other communication mailed to the Customer at the address given is presumed to be duly received by the Customer if and when mailed to the address maintained in the Bank's registers.

8.

The Bank and the Customer submit to the jurisdiction of the Civil Courts of the United Arab Emirates but without prejudice to the Bank's general right to take proceedings, where necessary, in any other Court of competent jurisdiction.

9. If a Customer maintains an Account with the Bank denominated in any currency other than United Arab Emirates (AED), the following conditions will also apply
 
  
a)
Any amount withdrawn by the Customer shall be paid in the currency in which the Account is denominated The withdrawal may be made in cash, by Demand Draft, Mail Transfer or any other means as required by the Customer subject to deduction of commission and/or charges as per Bank Tariff as applicable Withdrawals in cash will require prior written notice from the Customer. The notice period will be determined by the Bank at the time of withdrawal. Foreign currency exchange rates will be determined by the Bank.
b)
The Bank shall have no responsibility for or liability to the Account Holder for any diminution due to taxes or imposts or depreciation in the value of funds credited to the Account.
c)
The Bank shall have absolute discretion, upon providing a 15 days' notice to the Account Holder(s), to discharge of its entire liability with respect to the Account or may close the Account whereby it shall mail to the Account Holder(s), at the address last recorded with the Bank, a Bankers' draft in the amount of the then credit balance of the Account and in the currency in which the Account was denominated payable to the Account holder(s) without recourse on the Bank as drawer of the draft.
d)
The dealings in the funds by the Bank in accordance with the Customers' Instructions and/or the provisions of this agreement shall be a full and complete discharge for the Bank from all liabilities and obligations with respect to the balance of the Account and interest accrued thereon.
  
10. The Bank reserves the right to amend or add to these conditions at any time by notifying the Customer by means of any communication as desired by the Bank.
11.

Customer shall maintain such minimum balance in the Account as the Bank may prescribe from time to time. Such amount will be advised by a notice displayed through the Bank's Website.

12.

In the case of deceased Account Holder the heirs or other persons entitled to receive the property of the deceased Account Holder must establish their rights in accordance with the laws in force.

13.

The Bank reserves the right to close any Account without assigning a reason. This will not constitute any obligation on the part of the Bank who will inform Account Holder(s) of such action.

14.

The Bank shall have the right to freeze credit balances in any of the Accounts in the name of the Customer or any associated Account pursuant to the law or on receipt of a Court Order to this effect.

15.

The Bank may report any Money Laundering Transactions or any other suspicious activity in or related to any Account to the appropriate authorities in compliance with the relevant laws and regulations.

16.

Disclosure of Information

 
  
a)
The Customer acknowledges that the Bank is authorized to respond to any other banks enquiries relating to the Customers status without any responsibility or commitment on the part of the Bank or its officers by confidentially supplying the required information, without the Customer's prior approval or notice.
b)
The Bank is authorized to respond to enquiries of authorities other than banks, under the following special circumstances under compulsion of law; in the national interest and if and when required by local authorities.
 
CURRENT ACCOUNTS ONLY
  
17.

Debit balances of the Customer shall be debited with interest on the basis of the amount of the "available balance".

18.

The Customer must ensure the safekeeping of all cheque forms issued by the Bank and immediately notify the Bank in writing in the event of any loss or theft. If the Customer closes the Account all un-issued cheque book/leaves should be returned to any of the Bank's branches against a written receipt. If the Customer fails to give such notice or does not submit unused cheque book leaves at the time of Account closure, the Customer will be held responsible for any loss resulting from the misuse of such lost or stolen cheque forms.

19.

In the event of the Bank granting the Customer overdraft facilities to an extent and a period which the Bank in its sole discretion may decide, the Customer undertakes to pay interest on such overdraft at the rate specified by the Bank from time to time. Interest shall be calculated daily and compounded monthly. The Bank has the full right at any time, with notice to Customer by appropriate means, to change the rate of interest and in all circumstances the applicable rate is deemed and agreed to have the binding force of a contractual agreement between the Bank and the Customer.

20.

Credit balances in Current Accounts shall not earn interest for the Customer.

21.

The Customer must settle immediately all Accounts in debit together with interest charges and other expenses upon demand by the Bank for such repayment for whatever reason even if such facility was allowed by the Bank without prior arrangement or specific agreement of the Customer.

22.

The Bank is authorized to debit the Account with all expenses and disbursements incurred in recovering amounts owing to it including legal costs and costs of taking and realizing security.

23. Stop Payment Instructions will not be accepted by the Bank except in the event of loss or theft of a cheque or bankruptcy of the holder. The acceptance of a Stop Payment instruction by the Bank shall be at the complete liability of the Customer for whatever reason it might be made including legal costs, fees, penalties, etc. In case of Stop Payment for loss of a blank cheque or cheque book, the Customer may be required by the Bank to close the Account and open a new Account. Stop Payment instruction will only be accepted in writing on Bank forms containing conditions for Stop Payment. The Bank may accept Stop Payment instructions on a request by letter from the Customer provided the Customer subsequently confirms this request by signing the Banks Stop Payment form, and the Bank shall not be held liable for and shall be indemnified by the Customer against any consequences in the meantime.
24.

While issuing Cheques to third parties, it is Customer's obligation to ensure strict adherence to UAE Central Bank requirement not to issue Cheque without available balance. However, if such Cheques are issued, the Bank has the authority to close the Account when the number of Cheques returned due to insufficient funds exceeds FOUR within the span of one year.

25.

For each Cheque that is returned by the Bank due to insufficient funds, the Account will be debited with related charges as prescribed by the Bank.

 
SAVINGS ACCOUNTS ONLY
  
26.The Bank recognizes no owner of a Savings Account balance other than the person in whose name the Account has been opened.
27. The Bank should be informed promptly of any change of address of the Customer.
28.

The Customer must present himself in person to make any withdrawals from the Account.

29.

Cheque Books will not be issued to Savings Account(s). The withdrawal form supplied by the Bank must be completed and presented when withdrawal is to be made at the Branch counter.

30.

Withdrawals may be made as frequently as required subject to the minimum balance being retained

  
a)
Interest at the rate to be determined from time to time by the Bank will be allowed on monthly minimum balances.
b)
The Bank reserves the right to change the rate of interest allowed. Details of any changes will be exhibited on the Bank's Website www.nbad.com.
c)
If the minimum balance during the month falls below the limit decided by the Bank no interest will be paid and the Account will be charged for monthly maintenance, if applicable.
d)
Interest earned will be credited to the Savings Account half yearly in June and December.
e)
A Customer who does not wish to receive interest must advise the Bank accordingly in writing.
7.6 Supplementary Debit Card(Cashplus and Cashplus Global)
  
7.6.1Being an NbadDirect Customer, you MUST possess either a Cashplus or Cashplus Global (or both) Cards to be used for all your Cash/Cheque deposits, Cash withdrawals and other related services using ATMs and purchasing of goods and services using Point of Sales Terminals installed at several outlets.
7.6.2 Once the Account is opened, the Bank will produce your Debit Card(s) and related PIN(s) with details you have provided to the Bank on the Account Opening Form.  
7.6.3 The Card(s) and related PIN(s) will be forwarded to your address in separate envelopes however both placed in the same pouch through the Bank's official Courier. You need to acknowledge receipt of the Card(s) and PIN(s) by signing the Acknowledgement Note attached to the sealed envelopes and hand it over to the representative of the Courier Company.
7.6.4Your Debit Card(s) will be activated by the Bank on receipt of the Acknowledgement Note.
  
Supplementary Card(s)
  
7.6.5You may seek Supplementary Card(s) in the name(s) of your relative(s) by electronically submitting the "Request for issuance of Supplementary Debit Card" available in nbadOnline. You will be required to keep a photocopy of the Supplementary Card holder's passport duly verified and attested stating "true copy of the original" readily available for handing it to the DSF staff who will visit you to hand over the Supplementary Card.
7.6.6 When the Supplementary Card is ready, the DSF staff will call and visit your premises at the mutually agreed time, collect the photocopy of the passport duly attested by you, and handover the Supplementary Card and the PIN to you against your acknowledgement signature on the receipt. On receipt of the Supplementary Card, you will log on to nbadOnline and electronically submit "Request for Card Activation". The Supplementary Card will be activated before the end of the following Working Day.
7.6.7 It will be your responsibility to ensure that the Supplementary Card and PIN are handed over to the Supplementary Cardholder and the reverse of the Supplementary Card is signed by the Cardholder.
  
Cancellation/Replacement of Lost/Stolen Cards
  
7.6.8    If you wish to cancel or replace a lost/stolen Card(s) (either the Primary or the Supplementary) you need to log on to nbadOnline and electronically submit the "Request to Cancel and Reissue Cards".
7.6.9 In respect of lost or stolen Cards, you must also immediately block the Card by calling the Bank's Call Centre and providing the relevant information.
7.6.10 Replacement Card(s) and related PIN(s) will be dispatched to you in separate sealed envelopes which will be placed in the same pouch through the Bank's official courier. On receipt of the Replacement Card, you will submit "Request for Card Activation" to enable the Bank to activate the Replacement Card. In the absence of you submitting the Request, the Bank will activate the Replacement Card on receipt of your acknowledgement sent through the official courier.
7.6.11 In the event you lose your Primary/Supplementary Card and wish to seek a Replacement Card, you need to bear the cost of the Replacement Card. However, if you need to exchange the existing Card for any reason (spoilt, not functioning, damage etc.) you can obtain a Replacement Card free of cost.
7.6.12You will abide by the following Terms and Conditions:

 (CASHPLUS & CASHPLUS GLOBAL)

I/We accept and agree to be bound by the following Terms and Conditions of use as may be amended from time to time. I/we authorize you to debit my/our Account(s) for all amounts arising from the use of Principal and/or Supplementary Card(s) issued to me/us and/or any sum(s) deemed appropriate by the Bank.
1DEFINITIONS
 
(i)
"Bank” means National Bank of Abu Dhabi (NBAD), its successor(s) and/or assignee(s);
(ii)
“Card” means the NBAD Cashplus Card and/or the NBAD Cashplus Global Card;
(iii)
“Principal Cardholder” means a person maintaining a “Cardholder Account” (as defined below) and for whose use a Card is issued by the Bank;
(iv)
“Supplementary Cardholder” means a Cardholder nominated by the Principal Cardholder under condition 2 below;
(v)
“Cardholder” means the Principal Cardholder or a Supplementary Cardholder for whose use a Card is issued by the Bank.
(vi)
“Cardholder’s Account” means the Current and/or Savings Account maintained by the Principal Cardholder with the Bank.
(vii)
“PIN” means Personal Identification Number issued to the Cardholder.
 
2. The Cashplus and Cashplus Global Cards issued by the Bank are strictly for ELECTRONIC USE ONLY. Accordingly, these Cards should be used by the Cardholder only at designated Automated Teller Machines (ATMs) and Electronic Point of Sale Terminals (POSTs)

Mail Order, Telephone Order, Internet Transactions and other Transactions of a similar nature where the Card is not present and/or magnetic stripe is not read in full are strictly prohibited.

The Bank shall not be responsible for any loss or damage, financial or otherwise, which a Cardholder may sustain as a result of unauthorized use of the Card as stated above. However, the Bank reserves the right to debit the Cardholder's Account with the value of all such non-electronic Transactions.

3.The Bank may issue Supplementary Card(s) to person(s) nominated by the Principal Cardholder. However, the Principal Cardholder will be irrevocably, unconditionally, and fully liable for all amounts which may arise from the use of Supplementary Card(s) or Card number(s).
4. Cash deposits made through NBAD ATMs will be credited to the Cardholder's Account on the following Working Day subject to physical counting and verification by the Bank. Cheques deposited will be credited to the Cardholder's Account upon actual realization by the Bank of the funds representing the amounts of the cheques.
5.

Cash deposits made through NBAD ATMs will be credited to the Cardholder's Account on the following working day subject to physical counting and verification by the Bank. 6.

The amount of any ATM and/or POS transaction in a currency other than U.A.E. Dirhams will be converted at a rate of exchange determined by the Bank for the date when the ATM or POS transaction is debited to the Cardholder's Account. In addition, cash withdrawal, balance enquiry and other permitted Transactions at Non-NBAD ATMs and/or POS terminals shall attract a transaction based fee which shall be determined by the Bank from time to time.

7.

The Bank may at anytime, without notice, cancel or suspend the right to use the Card or refuse or replace any Card, without affecting the Cardholder's obligations set out in these Terms and Conditions which shall remain in force until all liabilities of the Card have been finally, fully and satisfactorily settled.

8. The Card must be signed by the Cardholder immediately on receipt and may only be used :
(i) By the Cardholder.
(ii) Subject to the Terms and Conditions prevailing/applicable at the time of use.
(iii) Within the available balance in the Cardholder's Account.
(iv) Subject to the right of the Bank, in its absolute discretion and without prior notice, at any time to withdraw the right to use the Card for, or to refuse any request for authorization of any particular Card payment or cash withdrawal and to communicate any such withdrawal or refusal to any third party.
9. The Bank shall debit the Cardholder's Account with the amount of all cash withdrawals, transfers, direct debits, payments for goods and services at NBAD or any other Point of Sale Terminals (POST) and any other payments effected by the use of the Card along with the related Bank Charges. If however, for any reason the Cardholder's Account is overdrawn as a result of the use of the Card, the Cardholder is responsible for repayment of such debt together with interest, charges and commission, on first demand by the Bank.
10. The Bank shall not be liable if the Card is not honoured by a third party or if for any reason, the Automated Teller Machine or Point of Sale Terminal fails to accept the Card. Further, the Bank shall not be responsible for goods and/or services purchased by the Cardholder on the Card and in all circumstances, the Cardholder must accept all debits arising as a result of the use of the Card.
11.

The Card and related PIN are issued to the Cardholder at his/her own risk, and the Bank shall bear no liability whatsoever for any loss/damage arising from the use of the Card and/or related PIN.

12.

The Cardholder must keep the PIN secret and exercise all possible care to ensure the safety of the Card to prevent misuse. If the Card or PIN are lost or stolen, the Cardholder must immediately contact the Customer Contact Centre (Call Centre) to block the Card and subsequently request for a replacement Card and/or PIN, as the case may be.

13.

The Bank has the right, without reference to the Cardholder, to increase or decrease the maximum ATM withdrawals amount, number of ATM withdrawals permitted and/or the maximum Payment Card Transactions amount and number of Transactions permitted.

14.

The Bank issues Cards on the understanding that goods or services obtained with a Card will not be resold or returned for cash refund. However, goods or services may be returned for credit to the Cardholder's Account provided the merchant accepts such returns.

15.

The Cardholder shall at all times remain liable for any transaction made by the use of the Card and shall indemnify the Bank for any loss/damage howsoever caused by the unauthorized use of the Card or related PIN. The Bank's record of Card Transactions shall be conclusive and binding for all purposes, in particular for the purpose of legal evidence.

16.

The Cardholder must verify all Card Transactions appearing in the Cardholder's Account Statement. In case of any discrepancy(ies) or dispute, the Cardholder must notify the Bank in writing within two weeks from the statement date, failing which, all Card Transactions will be confirmed as correct.

17.

The Bank reserves the right to vary these Terms and Conditions without reference to the Cardholder. Subject to the requirements of law, notification of any such variation shall be given to the Cardholder by the Bank either in writing or by publication thereof by such means as the Bank may select and a variation so notified shall be binding on the Cardholder.

18.

The Terms and Conditions shall be construed and governed by the laws for the time being in force in the United Arab Emirates.

 

Note: The Customer should refer to the Bank for clarification of any Terms used in the form which are not fully understood, and the Bank will not be held responsible if the Customer does not obtain sufficient clarification prior to signing.

7.7 Open Time Deposit Account
  
7.7.1 You may open and operate a Time (Fixed) Deposit Account in AED or in any other currency acceptable to the Bank.
7.7.2 You need to maintain either an NbadDirect Current or Savings Account in order to open and operate a Time (Fixed) Deposit Account (hereinafter to be referred as "Account").
7.7.3 At present, all deposits and withdrawals to/from the Account need to be routed through your NbadDirect Current or Savings Account. Similarly, until such time as the Bank provides the facility to open and operate an NbadDirect Current or Savings Account in a foreign currency, the transferring of the interest gained on the Account or the principal amount of the Account need to be performed only through your NbadDirect AED Current or Savings Account.
7.7.4 If you wish to Open, Renew or Close an Account, you need to complete either the "Request to Open Time Deposit Account" or the "Request to Renew Time Deposit Account" or the "Request to Close Time Deposit Account" respectively which are available in nbadOnline and electronically submit such request.
7.7.5 While opening an Account, you should provide the Bank with the necessary Instructions to act upon on the maturity date. If you have instructed the Bank NOT to renew the deposit but subsequently you wish to change your Instructions and renew the deposit, then you need to electronically submit the "Request to Renew Time Deposit Account" 3 Working Days prior to the maturity date. If the Bank does not receive the Instructions before 3 Working Days, the Bank will act upon the Instructions you have provided to the Bank at the time of opening the Account.
7.7.6 When the deposit is renewed, the Bank will apply the interest rates prevailing on the renewal date.
7.7.7 Except for the notification that is sent to your e-mail address confirming the action taken by the Bank, you will not be provided with a written Advice confirming the deposit you made with the Bank.
7.7.8 You may access your Account through nbadOnline any time you wish and view all relevant details of the deposit (principal amount, interest rate, maturity date etc.,).
You can neither appoint any other person to act as your attorney or agent nor a joint Account Holder to the Account.
7.7.9 You may place a Deposit for a minimum period of seven days and a maximum of one year.
7.7.10 If you wish to make a partial withdrawal from the Deposit and renew the remaining amount for any period, you need to send a secure a request through nbadOnline providing the relative details.
7.7.11 You can view the interest rates the Bank would offer for all AED and US$ Deposits by accessing "Time Deposit Interest Rates" available on www.nbaddirect.com. The rates are indicative and displayed for information purpose only and it is subject to change at any time without a notice.
7.7.12 You will abide by the following Terms and Conditions:
  
 
TERMS AND CONDITIONS FOR FIXED (TIME) DEPOSIT
 
Each deposit made on, after or renewed subsequent to the date appearing on the face hereof is subject to the conditions of this Agreement here-in below.
1. Within a reasonable time after the commencement of the original deposit period or renewal, the Bank shall forward an e-mail notification to the e-mail address as for record keeping purposes.
2.

If the deposit is not renewed for an additional term, no interest will be paid on the deposited amount for any period following maturity as specified in the application or renewal form, as the case may be. In addition, no interest will be payable in the event of non-renewal of the deposit in relation to the period falling between (a) the maturity date, as specified in the application form or renewal form, as applicable,; and (b) the date of renewal of the deposit..

3.

In the event of the death or incapacity of one or any of the Account holders, the surviving party(ies) shall notify the Bank of the occurrence of such event within 10 days of its occurrence. The Bank will suspend all activities on the relevant Account(s) as of the date it receives such notification and will not release the deposited amount until the Bank is provided with the relevant grant of probate or a court order appointing a legal guardian, as the case may be, at which point the deposited amount will be released in accordance with the Instructions provided in such order(s).

4.

Unless otherwise agreed by Bank, foreign Currency Deposit withdrawals by means of transfer or demand draft may only be made at the expiration of the original or any additional deposit period and if so agreed to by the Bank; each withdrawal made by the depositor will be subject to the Terms and Conditions governing such withdrawals as are established by the Bank at the time of withdrawal.

5.

Amounts representing the principal of the deposit and any interest accrued thereon shall be payable in the currency in which the Account is denominated. The withdrawal may be made by a Demand Draft, Mail Transfer or any other means as required by the Customer subject to deduction of commission and/or charges per Bank Tariff as applicable. Withdrawals in cash will require prior written notice from the Customer. The notice period will be determined by the Bank at the time of withdrawal and the relevant amount will not earn interest during the notice period. Foreign currency exchange rates will be determined by the Bank.

6.

The Bank shall have no responsibility for or liability to the Customer for any diminution due to taxes or imposts or depreciation in the value of funds credited to the Account.

7.

The Bank shall have absolute discretion, upon providing a 15 days' notice to the Account Holder(s), to discharge of its entire liability with respect to the Account or may close the Account whereby it shall mail to the Account Holder(s), at the address last recorded with the Bank, a Bankers' draft in the amount of the then credit balance of the Account and in the currency in which the Account was denominated payable to the Account Holder(s) without recourse on the Bank as drawer of the draft.

8.

The dealings in the funds by the Bank in accordance with the Account Holders' Instructions and/or the provisions of this Application shall be a full and complete discharge for the Bank from all liabilities and obligations with respect to the balance of the Account and interest accrued thereon.

7.8 NBAD Credit Card
  
7.8.1 You can apply for a NBAD Credit Card (Visa or MasterCard) by completing the "Request for NBAD Credit Card" available in nbadOnline and electronically submitting the Request.
7.8.2 On receipt of the request, a DSF staff will call and meet you at a mutually agreed time and place.
7.8.3The DSF staff will explain the requirements for obtaining a Credit Card, ensure your eligibility and provide you with the relevant Credit Card Application Form that you need to complete and sign in the presence of the DSF staff.
7.8.4 If you are eligible for a Credit Card as per the requirements of the Bank, the Credit Card and the related PIN will be dispatched to your address in separate envelopes but in the same courier pouch through the Bank's official Courier. You need to acknowledge the receipt of the Card by signing the relevant acknowledgement slip and hand it over to the representative of the Courier Company.
7.8.5On receipt of your Card, you will call nbadCall Centre, identify yourself and request to activate the Card.
  
Supplementary Card
  
7.8.6You may apply Supplementary Card(s) in the name(s) of your relative(s) by electronically submitting the "Request for issuance of Supplementary Credit Card" available in nbadOnline. You will be required to keep a photocopy of the Supplementary Card holder's passport duly verified and attested stating "true copy of the original" readily available for handing it to the DSF staff who will visit you to hand over the Supplementary Card.
7.8.7When the Supplementary Card is ready, the DSF staff will call and visit your premises at the mutually agreed time, collect the photocopy of the passport duly attested by you, and handover the Supplementary Card and the PIN to you against your acknowledgement signature on the receipt. On receipt of the Supplementary Card, you will log on to nbadOnline and electronically submit "Request for Card Activation". The Supplementary Card will be activated before the end of the following Working Day.
7.8.8 It will be your responsibility to ensure that the Supplementary Card and PIN are handed over to the Supplementary Cardholder and the reverse of the Supplementary Card is signed by the Cardholder.
 
Cancellation/Replacement of Lost/Stolen Card
 
7.8.9 If you wish to cancel or replace a lost/stolen Credit Card (either the Primary or the Supplementary) you need to log on to nbadOnline and electronically submit the "Request to Cancel and Reissue Cards".
7.8.10 In respect of lost or stolen Card, you must also immediately block the Card by calling the Bank's Call Centre and providing the relevant information.
7.8.11 The Replacement Credit Card and the related PIN will be dispatched to your address in separate envelopes but in the same courier pouch through the Bank's official Courier. On receipt of the Replacement Card, you may call nbadCall Centre, identify yourself and request to activate the Replacement Card.
 
7.8 Supplementary Credit Card

7.9 Demand Draft
  
7.9.1 You can request the Bank to issue a Demand Draft ("Draft") in any currency to the debit of your NbadDirect Current or Savings Account by electronically submitting the "Request for Issuance of Demand Draft" available in nbadOnline .
7.9.2 You must keep sufficient available balance in your Account to cover the value of the Draft and all relevant charges. In the event there is no sufficient available balance in the Account and due to which the Draft could not be issued, the Bank will not be responsible or liable for any consequences that may subsequently occur.
7.9.3If the Draft could not be issued due to insufficient funds or for any other reasons (incomplete address, incomplete beneficiary details etc.,), you will not be notified by the Bank for not processing the Request. However, whenever the Request is being processed and the Draft is issued, you will receive an e-mail notification with all relevant details of the Draft.
7.9.4 When you need to issue the Draft in a foreign currency, the Bank will apply the selling rate of the currency against AED as per the exchange rate applicable at the time of processing the transaction.
7.9.5 On issuing the Draft, you will receive an e-mail notification in your selected e-mail address to confirm the processing of the Request. Irrespective of whether you have received an e-mail notification or not, you should log on to nbadOnline, access your online Transactions Statement and ensure that the value of the relevant Draft is being debited to the Account.
7.9.6 The Bank will dispatch the Draft as per the Instructions you have provided on the Request. If you require the Bank to forward the Draft using a Courier service, the cost of the Courier service will be recovered from your Account.
7.9.7 If you wish to personally collect the Draft at any NBAD branch, on receiving the Draft, you will acknowledge receipt of the Draft on the acknowledgement copy and handover the acknowledgement to the branch.
7.9.8 If you wish to convey any message to the beneficiary of the Draft, you may include the relevant information on the space provided on the screen to enable the Bank to send the appropriate message to the beneficiary along with the Draft.
7.9.9 You will abide by the following Terms and Conditions:
 
 
TERMS AND CONDITIONS FOR DEMAND DRAFTS
 
1. In the event of loss of, damage to or mutilation of the Demand Draft, the Bank shall not be liable if payment was made to persons other than payees or bona-fide endorser, unless it is promptly notified and asked to take precautionary measures.
2.

The Bank shall not be responsible or liable for damages if the Draft is not rendered for payment to the branch/correspondent within twelve months from the date of issue.

3. The Bank shall not be liable if the payment of the Draft is stopped or funds withheld by action of a competent authority for any reason or cause whatsoever.
 
7.10 Manager Cheque
  
7.10.1 You can request the Bank to issue a Manager's Cheque in AED to the debit of your NbadDirect Current or Savings Account by electronically submitting the "Request for Issuance of Manager's Cheque" available in nbadOnline.
7.10.2 You must keep sufficient available balance in your Account to cover the value of the Manager's Cheque and all relevant charges. In the event there is no sufficient available balance in the Account and due to which the Cheque could not be issued, the Bank will not be responsible or liable for any consequences that may subsequently occur.
7.10.3 On issuing the Manager's Cheque, you will receive an e-mail notification in your selected e-mail address to confirm the processing of the Request. Irrespective of whether you have received an e-mail notification or not, you should log on to nbadOnline, access your online Transactions Statement and ensure that the value of the relevant Manager's Cheque is being debited to the Account.
7.10.4The Bank will dispatch the Manager's Cheque as per Instruction you have provided on the Request. If you require the Bank to forward the Manager's Cheque using a Courier service, the cost of the Courier service will be recovered from your Account.
7.10.5If you wish to personally collect the Manager's Cheque at any of NBAD branch, on receiving the Manager's Cheque you will acknowledge receipt of the Manager's Cheque on the acknowledgement copy and handover the acknowledgement to the branch.
7.10.6 If you wish to convey any message to the beneficiary of the Manager's Cheque, you may include the relevant information on the space provided on the screen to enable the Bank to send the appropriate message to the beneficiary along with the Manager's Cheque.
7.10.7 All Manager's Cheque issued by the Bank will be crossed with "Account Payee Only" without exception.
7.10.8 You will abide by the following Terms and Conditions:
  
 
TERMS AND CONDITIONS FOR MANAGER'S CHEQUE
 
1. In the event of loss of, damage to or mutilation of the Manager's Cheque, the Bank shall not be liable if payment was made to persons other than payees or bona-fide endorser, unless it is promptly notified and asked to take precautionary measures.
2.

The Bank shall not be responsible or liable for damages if the Manager's Cheque is not rendered for payment to the Bank within SIX months from the date of issue.

 
7.11 Balance Confirmation Letter
  
7.11.1 If you wish to obtain a Certificate/Letter from the Bank confirming the outstanding current balance of any of your Accounts with the Bank, you may electronically submit the "Request for Balance Confirmation Letter" available at "nbadOnline"
7.11.2 The Certificate will be produced and forwarded as per your Instruction detailed on the Request.
7.11.3 When the Certificate is forwarded by using a Courier service, the relevant cost will be debited to your NbadDirect Account specified on the Request.
 
7.12 Update Address / Contact details
  
7.12.1Whenever you need to change your postal addresses/contact details you should provide the Bank with all relevant details on the "Request to Update Address/Contact Details" available in nbadOnline and electronically submit the Request for appropriate action.
7.12.2While the changes you seek to your Address, Phone and Telefax numbers will be made only to the selected Account, all other changes on your Personal Information (passport, visa, e-mail address etc.,) will be made to ALL your Accounts (i.e. NbadDirect and other) that you maintain with the Bank as of the date you require the change.
7.12.3 If you wish the Bank to amend your passport/visa details, you will be required to produce the original passport (along with a photocopy) containing the relevant visa page to the DSF staff who will call on you and meet you at a mutually agreed time and place. The DSF staff will verify the validity of passport/residence visa and return the original passport to you. The passport and visa details will be updated in Bank records after verification of details by the DSF staff.
7.12.4 In respect of other details (employment data, etc.,), the DSF staff may seek appropriate records to substantiate your statement.
 
7.13 Personal Installment Loan
  
7.13.1 If you wish to apply for a personal loan, you may complete the "Request for Personal Instalment Loan" available in nbadOnline and submit the Request electronically to the Bank.
7.13.2 On receipt of the Request, a DSF staff will call on you and meet you at a mutually agreed time and place. He/She will seek certain information, explain the requirements that are necessary for seeking a Personal Loan and ensure your eligibility for the prescribed Loan amount. He/She will also advise the list of documents that you need to keep ready at the time of his/her visit.
7.13.3 On visiting your premises, the DSF staff will provide you with the relevant Personal Finance Facility Application Form that you need to complete and sign in his/her presence.
7.13.4 If the Loan amount is approved for disbursement, the DSF staff will call you and provide with all relevant information (amount approved, interest rate, instalment amount etc.,), confirm the date of disbursement of the loan amount to your prescribed NbadDirect Account and liaise with you for further necessary action to be completed by you.
7.13.5 On processing the loan disbursement, the Bank will forward an e-mail notification to your e-mail address confirming the action taken by the Bank.
 
7.14 Sayyarati Loan
  
7.14.1 If you wish to apply for a Sayyarati Loan, you may complete the relevant "Request for Sayyarati Loan" available in nbadOnline and electronically submit the Request to the Bank.
7.14.2 On receipt of the Request, a DSF staff will call on you and meet you at a mutually agreed time and place. He/She will seek certain information, explain the requirements that are necessary for seeking a Sayyarati Loan and ensure your eligibility for the prescribed Loan amount. He/She will also advise the list of documents that you need to keep ready at the time of his/her visit.
7.14.3 On visiting your premises, the DSF staff will provide you with the relevant Sayyarati Loan Application Form that you need to complete and sign in his/her presence.
7.14.4 If the Loan amount is approved for disbursement, the DSF staff will call you and provide with all relevant information (amount approved, interest rate, instalment amount etc.,) and liaise with you for further necessary action to be completed by you.
 
7.15 Cash Deposits and Withdrawals
  
7.15.1 For Cash deposits and withdrawals from/into your NbadDirect Account, you will primarily use the services of ATMs installed at several NBAD branch/offsite locations and for Cash deposits you will use Cash Deposit Machines installed at several NBAD branch locations.
7.15.2 You will refrain from using the branch Teller services unless it is necessary to use the service due to unavoidable circumstances such as ATM break down, system malfunctions etc., If you wish to use the Teller counter of any NBAD branch to deposit/withdraw Cash to/from the Account while you can use the ATM or the Cash Deposit Machine installed at the same branch, the branch may levy a service charge from you for rendering the service by the Branch Teller. However, beneficiaries/bearers holding Cheque(s) issued by you on your NbadDirect Account can present the Cheque for payment at any of NBAD branch Teller counters without any restriction.
7.15.3 Under no circumstances, you will hand over Cash to DSF staff. The DSF staff are not authorized to receive or deliver Cash from/to you.
7.15.4 All Cash deposits/withdrawals into/from your Account will be acknowledged via a consolidated e-mail notification sent to your preferred e-mail address as per Bank records.
 
7.16 Cheque Deposits
  
7.16.1 For depositing of AED Cheques drawn on banks within UAE into your NbadDirect Account, you will primarily use the ATMs and Cheque Deposit Machines installed at several NBAD branch locations. The list of branch locations where ATMs are installed is available on the Bank's Website www.nbad.com.
7.16.2 You will refrain from using the branch counter service unless it is necessary to do so due to unavoidable circumstances such as ATM break down, system malfunctions etc., If you wish to use the branch counter service of any NBAD branch to deposit AED Cheques while you can use the ATM or the Cheque Deposit Machine installed at the same branch, the branch may levy a service charge from you for rendering the service at the branch counter. However, if a third party wishes to deposit AED Cheques into your Account, he/she may use the branch counter service without any restriction.
7.16.3The Cheques you wish to deposit in the Account through ATMs/Cheque Deposit Machines must be issued in your name and marked "Account Payee Only". For deposit of other Cheques i.e. bearer Cheques properly endorsed in your name, you may approach any NBAD branch.
7.16.4 In respect of Foreign Currency Cheques, it may be deposited at any NBAD branch by completing the required Deposit Form available at the branch counter.
7.16.5 If you need to deposit Cheque(s) of amounts more that AED250,000/- or equivalent per item, you may seek the personal service of the DSF staff who will visit you at a mutually agreed time and place and collect the Cheque(s) against a Receipt properly stamped and signed by the staff. You must hold the Receipt in your possession until you confirm receipt of the proceeds in the Account or return of the Cheque by the issuing bank. You must ensure that the Cheque(s) deposited through the DSF staff are issued in your personal name, properly crossed "Account Payee Only" and a copy of the Cheque is retained with you for records.
7.16.6 When the Cheque(s) (either drawn on banks within or outside UAE) deposited to your Account is/are returned unpaid by the issuing bank(s), you will be personally informed by the Bank and notified through an e-mail via nbadDirect@nbad.com within 3 days from the receipt of the returned Cheque by the Bank. You may either opt to personally collect the returned Cheque through an NBAD branch that is convenient for your approach or to receive the Cheque through the Bank's official Courier without any responsibility on our part against delay/loss of the document in transit by the Courier. You need to acknowledge the receipt of the returned Cheque on the Acknowledgement Receipt attached to the returned Cheque and hand it over to the representative of the Courier Company and confirm receipt by an authenticated e-mail via nbadOnline. In the absence of your Instruction to the Bank for delivery of the returned Cheque, it will be held under our custody until receipt of your Secured e-mail through nbadOnline.
7.16.7 You will abide by the following Terms and Conditions:
  
 
TERMS AND CONDITIONS FOR CHEQUE DEPOSITS
 
1. Cheques deposited will be credited the same day but the funds will not be available for withdrawal until value is received from the bank(s) which the relevant cheque is drawn upon. However, Cheques received by the Bank DSF staff will be deposited before the end of the following Working Day.
2.

Where, exceptionally, the Bank allows withdrawal against a cheque before value is received; it reserves the right to charge interest at current rates.

3.

The Bank also reserves the right to:

  
a)
Reserve an entry or debit the Account with the value plus interest if any cheque deposited is subsequently returned unpaid.
b)
Correct any error found on the deposit form.
  
4. The Bank acts as an agent of the depositor when receiving Cheques for deposit and as such assumes no responsibility for delay or loss.
5. Cheques deposited are accepted by the Bank on the understanding that the Customer assumes full responsibility for the genuineness and correctness of all signatures and endorsements appearing thereon.
6. The Cheque could be deposited by using ATMs, Cheque Deposit Machines and/or at the Branch counters.
 
7.17 Cheque Book Request
  
7.17.1 You may request new Chequebook(s) containing 25 leaves by electronically submitting the "Cheque Book Request" available in nbadOnline, or through the Bank's ATMs or the Call Centre.
7.17.2 All Cheque leaves will bear the address "NbadDirect - Khalidiya" printed upon.
7.17.3 If Cheque books are requested through ATMs or the Call Centre, the Bank will forward the Chequebook through the Official Courier at the Bank's cost to your address in UAE as maintained in the Bank's records. You need to acknowledge receipt of the Chequebook on the Acknowledgement Receipt attached to the Chequebook and hand it over to the representative of the Courier Company.
7.17.4 If you wish to receive the Chequebook through a branch convenient for your collection, you need to electronically submit "Cheque Book Request" mentioning the branch where you wish to collect the Chequebook. The new Chequebook will be ready for collection within 3 days from the request date.
7.17.5You will abide by the following Terms and Conditions:
 
  
TERMS AND CONDITIONS FOR ISSUING CHEQUE BOOKS
  
For your and our safety, you should follow the under-mentioned guidelines.
  
1.

Use the Cheques only for the Account for which they are issued.
The Cheques may be presented at any National Bank of Abu Dhabi branch / cash office in the UAE.

2.

Write the Cheques clearly without leaving any large spaces between the words or figures.

3.

Protect the Chequebook by always keeping it in a safe place. In accordance with UAE law, the drawers of Cheques will be deemed particularly at fault if the drawer fails to exercise the due care necessary for the protection of Cheques.

4.

You may stop payment of a Cheque only if it is lost/stolen or if the bearer becomes bankrupt or insolvent. If any Cheques are lost or stolen you should notify the Bank immediately. Notification by telephone must be confirmed in writing by yourself. The Bank reserves the right to block your Account, if it so deems necessary.

5.

The Bank will not accept alterations, changes or additions on Cheques unless those alterations/changes/additions are confirmed against your full signature.

6.

Do not write on the blank space below the signature line provided for MICR processing.

7.

The Bank will issue a new Chequebook to you in person or send it by post only upon an authenticated request. You need to safe guard your Chequebook and ensure that the Chequebook is properly bound and Cheque numbers on the leaves matches with the number range printed on the cover of the Chequebook.

 
7.18 Payments/Remittances/Transfers
  
7.18.1 You may perform Payments, Remittances and Transfers on your NbadDirect Account following the requirements detailed in nbadOnline User Guide available at the Bank's Website www.nbad.com or www.nbaddirect.com
7.18.2 The details of the Transactions processed under these options will not be separately advised through an e-mail notification as in the case of other financial Transactions that are electronically processed on NbadDirect Account. However, the details of transaction(s) will be included in the consolidated e-mail advice sent to you at the end of the day.
 
7.19 Bank Tariff
  
7.19.1 As an NbadDirect Customer, you are eligible for reduced Tariff charges for products and services as described on the Bank Tariff Schedule posted in the Bank's webpage www.nbaddirect.com. If a service provided by the Bank is not included in the Tariff schedule you may contact either a branch, DSF Staff or the Manager NbadDirect Unit at Head Office.
